HYPOCRISY: SPI should be suing itself because it marketed antimicrobial way more aggressively than FIGS ever did
Despite suing us for it, Strategic Partners, Inc. used the same antimicrobial treatment as FIGS and yet made even stronger claims about it. SPI actually pushed that stronger language to the public WAY harder than FIGS ever did.
On the hangtag of our product (yes, the hangtag . . . the thing that you throw in the trash after buying the product), FIGS included language saying that its antimicrobial fabric “kills bacteria and infection immediately on contact.”
On the other hand, SPI issued press releases and lengthy promotional videos extensively touting the same antimicrobial treatment as being a “game changer” that turns “ordinary scrubs into a protective shield,” “contributing to peace of mind for healthcare workers” because, among other things, “when the undesirable bacteria come into contact with CERTAINTY-treated fabrics, the growth of the bacteria is disrupted and the bacteria are continually reduced.”
Good luck figuring out how SPI has any ground to sue FIGS over this. If it wants to sue someone, maybe SPI should sue itself.
